Apimimic Terms of Service

These Terms of Service (the “Terms”) outline your rights and responsibilities when using Apimimic’s mock API services, related websites, and any associated tools or resources (collectively, the “Service”). By creating an account, subscribing, or otherwise using the Service, you agree—on behalf of yourself or the entity you represent (collectively, “you”)—to these Terms, as well as the Apimimic Privacy Policy (the “Privacy Policy”). Please read these Terms carefully before using the Service.

Apimimic (“we,” “us,” or “our”) may modify these Terms at any time by posting the updated version here or notifying you via email or the Service. Your continued use of Apimimic after any such changes indicates your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

1. Overview of the Service

Apimimic provides a platform to create and manage mock APIs for testing, development, and demonstration purposes. Our offerings may include:

2. Account Registration and Responsibilities

  2. Account Security: You are responsible for maintaining the security of your account credentials. You agree not to share your username, password, or API keys with others. Any activity occurring under your account is solely your responsibility.

3. Trial Period and Right of Withdrawal

4. User Content and Conduct

4.1 User Content

You retain all rights to your User Content; however, you grant Apimimic a non-exclusive, worldwide, royalty-free license to host, reproduce, and process your User Content as necessary to provide the Service.

4.2 Prohibited Conduct

You shall not, and shall not permit others to:

  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to post or transmit unlawful, harassing, defamatory, obscene, or discriminatory content.

All trademarks, service marks, logos, designs, and other intellectual property related to the Service (“Apimimic IP”) are the exclusive property of Apimimic or its licensors. Except as explicitly granted, no license or right to use any Apimimic IP is provided. You agree not to copy, distribute, modify, or create derivative works of Apimimic IP without prior written consent.

7. Indemnification

You agree to indemnify, defend, and hold harmless Apimimic, its affiliates, employees, and licensors from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or connected with:

  • Your breach of these Terms;
  • Your misuse of the Service;
  • Any User Content you submit, post, or make available through the Service;
  • Your violation of any law or the rights of a third party.

8. Disclaimers and Limitation of Liability

Disclaimers:

  • As-Is: The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • No Guarantee: We do not guarantee the accuracy, completeness, reliability, or availability of the Service at all times.
  • Third-Party Integrations: Apimimic may integrate or link to third-party services, but we are not responsible for their content, performance, or data practices.

Limitation of Liability:

To the maximum extent permitted by applicable law, Apimimic will not be liable for any direct, indirect, incidental, consequential, or special damages (including, but not limited to, loss of profits, business interruption, or data loss) arising from or in connection with your use of, or inability to use, the Service. In no event shall our cumulative liability exceed the total fees paid by you to Apimimic in the six (6) months preceding the event giving rise to the liability.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

9. Governing Law and Dispute Resolution

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the jurisdiction in which Apimimic is organized, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction to resolve any dispute or claim arising from or relating to these Terms or the Service.

Notwithstanding the foregoing, Apimimic reserves the right to seek injunctive or equitable relief in any jurisdiction to protect its intellectual property or confidential information.

10. Entire Agreement and Severability

These Terms, together with the Privacy Policy and any other legal notices or policies incorporated herein by reference, constitute the entire agreement between you and Apimimic regarding your use of the Service and supersede any prior agreements or communications (oral or written). If any provision of these Terms is deemed invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. A party’s failure to enforce any right or provision under these Terms does not constitute a waiver of that provision or any other provision.

By submitting any Feedback, you grant Apimimic a perpetual, irrevocable, worldwide, royalty-free, and transferrable license to use, reproduce, modify, and incorporate the Feedback in any manner without any obligation to compensate you.
